Terms and Conditions

These Terms and Conditions govern access to and use of the Enbiwatt site, under Portuguese Decree-Law no. 7/2004 of 7 January (electronic commerce) and other applicable legislation.

2. Purpose and nature of the site

Enbiwatt explains electricity bills and power purchase agreements (PPAs), and offers a simulator that compares your current contract against the market's offers.

The site is informative and is not a transactional platform: you cannot contract, pay or switch supplier directly through its pages. Any commercial relationship is formalised afterwards, in writing, under a separate proposal.

Submitting any of the site's forms does not in itself create a contractual obligation. It is the start of a conversation that may or may not lead to a formal proposal.

The site also provides a virtual assistant, which answers questions about bills, contracts and PPAs and can route your request to the team. Its answers are generated automatically and are informative in nature: they are not a proposal, a quotation, technical, legal or tax advice, nor any contractual commitment by Enbiente. Points 3, 5 and 6 apply to it, with the necessary adaptations.

3. What the simulation is, and what it is not

This is the most important clause in these Terms, and it is worth reading.

The simulation is an estimate. It is calculated from the data you gave us, or from the bill you sent us, and compared against market offers known at the time it is made.

It follows that:

It depends on the data provided
incomplete or incorrect data produces an incorrect result. The figures should be checked against your bill.
It describes a moment
energy prices and offer conditions change. A simulation made today may not reflect tomorrow's conditions.
It is not a contractual offer
it does not constitute an offer, does not bind Enbiente or any supplier, and does not guarantee that any contract will be accepted by them.
It does not replace reading the contract
the conditions that actually bind you are those of the contract you go on to sign with the supplier you choose.

4. Acceptance and capacity

Accessing and using the site implies knowledge and full acceptance of these Terms. If you do not agree with any of their clauses, you should leave the site.

By submitting any form you declare that you are 18 or over and have the legal capacity to do so, and to bind any entity you may represent.

5. Use of the forms and sending your bill

By submitting any of the site's forms, you undertake to:

Provide truthful information
accurate and up to date.
Send only your own documents
you must not send bills or documents belonging to third parties without their authorisation.
Not use the site for unlawful purposes
in particular offensive or fraudulent communications, spam, or any use contrary to good faith.
Not interfere with the service
in particular through automated submissions or attempts to overload it.
Use the virtual assistant in good faith
do not use it to obtain unlawful, offensive or misleading content, do not try to circumvent its limits or induce it to produce answers on Enbiente's behalf that Enbiente would not stand behind, and do not submit other people's personal data without being entitled to.

6. Availability and accuracy of content

Enbiente makes reasonable efforts to keep the site available and its content current, but cannot guarantee:

Continuous availability
the site may be temporarily unreachable for maintenance, technical work, network failures or force majeure.
Absence of errors
typographic, technical or content errors, which will be corrected as soon as they are found.
Permanent currency
the educational content describes rules, tariffs and figures that change over time. The examples shown, including the bill used to explain each line, are illustrative and refer to the date stated on the relevant page.
Accuracy of the assistant's answers
they are generated automatically by a language model and, despite efforts to keep them correct and grounded in the site's own information, they may contain errors, omissions or out-of-date information. They should not be taken as a binding statement by Enbiente. Before taking any decision on the strength of an answer, in particular about tariffs, contracted power, deadlines, savings or legal and tax treatment, confirm it with the team. Where an answer conflicts with the content published on the site or with a written proposal from Enbiente, the latter prevail. Enbiente does not guarantee the assistant's continuous availability and may suspend or discontinue it at any time; the simulator and the site's forms remain available if it does.

7. Intellectual property

All elements of the site, in particular text, images, logos, icons, illustrations, source code, layout and visual identity, are the property of Enbiente or used by it under the applicable licences, and are protected by national and European law on copyright, trade marks and other intellectual property rights.

Without prior authorisation, end users may read and consult the site, quote short extracts with a clear attribution and a link to the original page, and share the site's public URLs.

Any other use, including reproduction, modification, distribution, commercial exploitation or decompilation of the source code, requires Enbiente's prior written authorisation.

Third-party logos and trade marks that may be referred to, in particular those of energy suppliers, belong to their respective owners and are used for identification purposes only.

8. Limitation of liability

To the fullest extent permitted by applicable law, Enbiente is not liable for:

Decisions taken on the basis of the site
in particular switching supplier or tariff on the strength of a simulation, without speaking to the team and without reading the conditions of the contract in question.
Indirect damages
loss of profits, loss of data or of commercial opportunities arising from the use of or inability to use the site.
Third-party sites
the content, policies or availability of sites Enbiwatt may link to.
Causes beyond its reasonable control
including force majeure, telecommunications provider failures, cyber attacks or the acts of third parties.
Decisions taken on the strength of an assistant answer
without confirming it with the team, as set out in point 6.

9. External links

The site links to third-party sites, in particular Enbiente's institutional site and the regulatory sources cited in the educational content, such as ERSE and DGEG. These links are provided for convenience. Enbiente neither controls nor endorses the content of those sites and accepts no responsibility for their accuracy, lawfulness or availability.

10. Force majeure

Enbiente is not liable for failure or defective performance of any obligation relating to the site that results from circumstances beyond its reasonable control, in particular natural disasters, widespread electricity or telecommunications failures, acts of public authority, labour disputes or pandemics.

11. Changes to the site and to these Terms

Enbiente reserves the right, at any time and without notice, to modify, suspend or discontinue the site, in whole or in part, and to update these Terms.

Continuing to use the site after an updated version is published constitutes acceptance of that version. The last-updated date shown at the top is the valid reference for the version in force.

12. Severability

If any clause of these Terms is held invalid, unlawful or unenforceable by a competent authority, that does not affect the validity and enforceability of the remaining clauses, which stay in full force.

13. Complaints and dispute resolution

Before escalating anything, we suggest contacting Enbiente directly so that the matter can be resolved amicably. Without prejudice to the above, Portugal's electronic complaints book is available.

14. Governing law and jurisdiction

These Terms are governed by Portuguese law.

For the resolution of any dispute arising from use of the site, the courts of the Comarca de Viseu are the agreed forum, with express waiver of any other, without prejudice to mandatory rules of law to the contrary.
